Is the use of the Avatar technology in the U.S. illegal (Robocalls)?

FTC RobocallsIf the main and only purpose of the software an illegal action then this software is illegal. In the case of the Avatar system is service legal because at the site from the Federal Trade Commission are listed a few cases where Robocalls are allowed:

Some prerecorded messages are permitted — for example, messages that are purely informational. That means you may receive calls to let you know your flight’s been cancelled, reminders about an appointment, or messages about a delayed school opening. But the business doing the calling isn’t allowed to promote the sale of any goods or services. Prerecorded messages from a business that is contacting you to collect a debt also are permitted, but messages offering to sell you services to reduce your debt are barred.

Other exceptions include political calls and calls from certain health care providers. For example, pharmacies are permitted to use prerecorded messages to provide prescription refill reminders. Prerecorded messages from banks, telephone carriers and charities also are exempt from these rules if the banks, carriers or charities make the calls themselves.

As you see in the above statement are legal and illegal purposes for Robocalls available. Illegal is this technology for making business (promoting any goods or services) in the United States of America. That the Avatar technology is a Robocall technology gets found out by reading the judgement from the United States District Court for the Southern District of Texas Houston Division, Civil Action No. H-13-2777, Case 4:13-cv-02777 from January 28, 2014 (.pdf). In this case Flowroute got sued to conspire with Avatar because: "Flowroute’s VoIP services, and employing Flowroute’s Calling Name Management Service ('CNAM-MS') to alter the caller’s identification as it appeared on Plaintiff’s cellular phone." Like expected had this case a positive end for Flowroute. The same way like Flowroute is Avatar only a service provider and is not responsible for the misusage of their products from their customers.

At Federal Trade Commission - Consumer Information - What to do if you get a Robocall explains the FTC attorney Kati Daffan in here video and in the first paragraph of the transcription what is a Robocall:

If you have a telephone, robocalls may be ruining your day. I'm Kati Daffan, an attorney at the Federal Trade Commission. If you answer the phone and hear a recorded message instead of a live person, it's a robocall. If the recording is a sales message and you haven't given your written permission to get calls from the company on the other end, the call is illegal period.

Playing pre-recorded messages or compile manually pre-recorded messages live will remain to be a prerecorded material and is never the same like speaking to a live person. There is no way to foresee all possibilities during a call. For this reason a live speaking agent cannot get replaced.

A short description of the Avatar system is that a call center agent is playing prerecorded messages to the called ones. The messages are getting selected depending on the answers from the called ones. With other words the called one does not speak with a real agent and for some questions are even no prerecorded answers available. Only if the called one is interested in the offer he gets transferred to a real person. One agents handles normally two calls at the same time. I think everybody knows the result of mulittasking.

Avatar is promoting their services as "Lead Generation without the accent". From my own experience and from the experience of my customers is it in the German speaking area of Europe (Austria, Germany and a part of Switzerland) not important to speak without an accent to make a sale. Much more important is it to adjust your own communication within splits of a second to the same level as your presumptive customer is using. A joke during the communication at the right time can be an ice breaker. This cannot get done by using prerecorded messages. Already the first impression a sales person is making can lead to a good business or to a total loss.

Avatar Technologies Phl, Inc. is providing their services only B2B and for this reason they need not warn about the misusage of their product. From business owners is it expected that they know the law in their country and in the country they are serving. For a consumer are the offered services not from any interest. For this reason they need not warn them about the illegal use of their products.

The FTC is challenging the DEF CON community to create a tool that people can use to block and forward unwanted robocalls automatically. Forwarded calls will go to a honeypot — a data collection system that researchers and investigators can use to study the calls. It is difficult for offshore call centers to provide their services by using a legal way. On one side they need to work lucrative on the other side they need to keep themselves on the law and government regulations of the destination country of their calls, what makes their work very difficult.

If you are watching the following video or read the transcript from the FTC attorney Kati Daffan, then you’ll get it that you are not allowed to greet the called one with a recording and if the center likes to sell something – what is in the most cases the reason for the call from an offshore call center – then the client of the center needs to have a written permission of their victims, which should get called.

The first problem with the greeting done by a life person can get easily handled by adjusting the dial system that every time is at least one free agent is available who can take the call immediately and greet the called one.

If the client provides calling data the second problem can get solved too. In respect to the data protection law is the client not allowed to provide more detailed information as can get found in a public phone directory. In any case should keep the center a copy of the data transmission or the email with the access to the data for having a proof. The center shall keep the proofs at least 10 years in evidence.

Few things can be more annoying than answering the phone while you're in the middle of something — and then being greeted by a recording.

If you receive a robocall trying to sell you something (and you haven’t given the caller your written permission), it’s an illegal call. You should hang up. Then, file a complaint with the FTC and the National Do Not Call Registry.

Consumers are getting more and more robo calls, and they are not happy about it. As the number of calls has multiplied, the number of complaints has, too. The reason for the spike in robo calls has to do with technology. Companies are using auto dialers, that can send out thousands of phone calls every minute, for an incredibly low cost.

What's important is that the companies that use this technology don't bother to screen for the numbers on the National Do Not Call Registry. If a company doesn't care about obeying the law, you can be sure they're trying to scam you. You've probably gotten robo calls about candidates running for office, or charities asking for donations. These robo calls are allowed. But any robo call that's trying to sell you something probably is illegal, unless you've given your written permission to get calls from that company.

The FTC has stopped billions, yes billions, of robo calls in the last two years. Tracing these calls is a tough job, and there are a few reasons for that. One, is that many different companies use the same, or very similar, recorded messages. Another, is that they fake the caller ID information that you see on your phone. That's called caller ID spoofing, and new technology makes it very easy to do. And the third, is that the robo callers often place the calls through internet technology, that hides their location.

Don’t forget that the fines in the U.S. are very high. Everybody who needs to defend himself in front of the law court will think first about himself and will very fast forget his given promises only for the reason that the fine will be a little bit less drastically. Your client will be coming first into the focus of the investigators, because you are selling his products. So your client or broker will in the best case provide the contact details of his partner in crime to the state attorney for getting a better deal for his own judgement. He will even try to make you alone guilty for his own fails. You need to have in this case proofs for your own protection and defense.

 

Blackmailer: Krishna Varma - Hyderabad - iamkrishnavarma@gmail.com

Blackmail the hobby that paysKrishna Varma does not know that blackmailing is a crime in each country. It is a pity that he got scammed, but that does not give him the right to become himself a criminal and blackmail others which have nothing to do with his case. He tries even to blackmail people which like to help him. Such a person has never learned something or have visited any school and cannot be a trusted business partner. With other words Krishna Varma did everything wrong what he could do wrong. Instead of asking for help and helping by the investigation he tried to blackmail everybody, which he found. With his try to blackmail others he destroyed every possibility that someone can help him.

If someone enters into a business, which does not bring him the expected profit, then he has the possibility to cancel the contract as soon as he gets it that he does not make any profit or he makes some losses. Blackmailing is not a legal way to correct his own wrong decision.

Krishna Varma from Hyderabad, email: iamkrishnavarma@gmail.com, does not understand how the offshore outsourcing business is functioning. Now he tries to impress with big words, baseless threats and blackmailing legal working companies. He is guilty by himself that he got scammed. He simple did not do his homework by making a background check. The mentioned campaign is for centers free available because the broker gets paid from the client.

That is a pity that he got scammed, but he can only file a case against this one, whom he has paid or he has made a contract and not against someone else. If he has paid any upfront fee then this one, which has taken the money has no contract with the client and would have disappeared already. The campaign itself is available for call centers free of charge and does not require any payments. Brokers and customers from brokers are not getting entertained.

The client will not pay something for that what he is not guilty for the case that he got scammed by the man in the middle method. If Krishna Varma likes to lose more money in such a case, than he can file a court case at the local court of the client. The Supreme Court and the court in India are not responsible for the case he has a contract with an U.S. company. Such a threat shows that Krishna Varma anything from business law. It would be recommended that he consults a good local attorney before he attacks others for his own fails. A cheaper way would be to file a case at the Federal Trade Commission (FTC). The FTC has for this purpose an Complaint Assistant, which can get found at https://www.ftccomplaintassistant.gov/.

It is in the US not illegal to hire offshore call centers for calling US customers. Would it be illegal then he liked to be a partner in crime of an illegal activity. He needs to provide victims and proves that called customers got cheated. That will be very difficult for an outsider.

Everybody, who made wrong investments, is guilty by himself. The business is hard and not a playground. Maybe Krishna Varma thinks that he is still playing in the sandpit. If Krishna Varma has made investments without having a valid contract with the client then he is guilty by himself because he did not prove the promises and trusted to the words of the scammer.

I got forwarded the following email with the comment from Robbie Middleton: “I have never seen this name Krishna Varma.”. As I only try to help by listing the scammers without any financial interest I have tried to get in contact with Krishna Varma and asked him to send me the email headers for finding out the scammers. He sent an answer how he felt betrayed, but he did not send one of the email headers, which makes it possible to find the man in the middle. That a man in the middle is exists is fact because he is not known from the client, but he can work.

Instead of delivering the necessary data he tried to attack me too with a baseless complaint where even not proves can get listed and tried to blackmail me too:

If someone is listing scammer and scams then you'll find revenges wherever some postings are not getting verified. As I'm not offering something or selling something on the Internet I'm not interested in such a case to take any action against such a posting - it would keep me only busy. If someone does not trust me for such a unproved posting than it his problem and not mine. I have not more and not less if someone belives me or not.

Krishna Varma needs to understand first that he is guilty for his losses by himself. Nobody is pressured into working on this campaign. There are other campaigns without any up-front fees available too. The demand determines the supply. That means if nobody likes to take a campaign then the payment will rise and if many centers like to get this campaign than the payment will come down.

The email looks like someone is searching a business partner, but this is only done at the first view. If we take a look at the email headers then we see the source of the email (I have made the source ip bold):

If you are not making any background check in such a case and you'll make business in such a case you'll be guilty by yourself for your losses. If you even don't help any investigation in such a case than you are even stupid and have no chance to get anything back.

 

A Scammer tries to bark: Ambuj Sahoo - Richa Software Solutions - richasoftwaresolutions.com

Ambuj Sahoo - Richa Software SolutionsAmbuj Sahoo tries to impress me with his barking and wrong information in his email. Instead of reading and try to understand first my article "Scammer: Richa Software Solutions - richasoftwaresolutions.com - Ambuj Sahoo - Priti Das" he tries to impress me with things, which I have never written about Richa Software Solutions, and he likes to distract with arguments which I have used for other scammer. It seems that Ambuj Sahoo is not able to read or he is not understanding English. Another possibility is that he has no arguments against what I have analyzed and tries to impress with barking for something completely different.

In summary is written at my previous article that the offered campaigns are not possible taking into account the law in the traditional outsourcing countries (Australia, Canada, European Union, New Zealand, USA). This argument is not invented. You can prove it by reading the Data Protection law of these countries. You can find even a court order by following the link in my article about "Data of 280,000 customers stolen: AT&T lost over $ 25 million". AT&T needed to pay a fine of US$ 25 million for 280,000 stolen customer data records during an outsourcing process. Do you really think that one company owner is so stupid and will risk such a fine by providing law protected data for you?

You can find a copy of the email which he sent to me on July 9, 2015 and on July 16, 2015 at the end of this article. In the following part I citate now only his arguments and comment them:

First of all if you go through my company domain ( www.richasoftwaresolutions.com) details then you can clearly see that every information about my company has been clearly DISPLAYED. All the details of my company address,e-mail id,contact details everything is very transparent to every one which is also mentioned on my website. Then how can you say that my information is secret and hidden on web.

The domain registry data are getting found at the end of my article "Scammer: Richa Software Solutions - richasoftwaresolutions.com - Ambuj Sahoo - Priti Das". Here gets already the first understanding problem found. The sentence "If you take a look at the Alexa global traffic rank, then you see that even the domain richasoftwaresolutions.com is a big secret on the web." means that nobody is visiting the domain richsoftwaresolutions.com. I suggest Ambuj Sahoo to change the person which is translating the content for him or to use Google translator. In any case he need to use his brain to get everything in context.

We never mention in our Project presentation that our parent client belongs to California,USA,then how COULD you KNOW that??

Here we have the next case that Ambuj Sahoo is not understanding English. I have written under the sample screenshot in my article "Scammer: Richa Software Solutions - richasoftwaresolutions.com - Ambuj Sahoo - Priti Das": "For the case that the provided date are an image the scam gets proven that not one in USA (San Bernardino is located in California, USA) will use such a character set." There is nowhere written that the client is from California, USA.

Yes we charge a Application Fees which is meant for our processing, legal documentation charge and deposit which we have to also forward to the vendor who allot us the project slots.

With this message is Ambuj Sahoo confirming that he is nothing else than a retailer of another scammer and he has no contract with any client. In this case, he has not fulfilled his commercial due diligence and is fully responsible for all disputes. In the worst case you have only the problem that you cannot reach into the pocket of a naked one.

Let us take a look again into the "Form Filling" offer from the retailer Richa Software Solutions. There is written:

  • 1 center with 10 ID's are earning 4,48,000 INR per month. That are arround US$ 7,060/month

  • The aggreement has a duration of 11 months. That means a center earns US$ 77,660 during the 11 months (7,060 * 11 = 77,660)

  • In the email is written "This is a very genuine process which is also continue in our nearly 100+ Indian centers with China,Philippines,Srilanka International center also." If it is already running on 100 centers then the client has to pay for the work US$ 7,766,000 during the 11 months. All companies at the world, which can have such a yearly budget for a "Form Filling" process, I can call in one or two hours.

The problem is only that all this companies have an army of computer programmers, data base specialists and operators which are doing a convertion of such data within a week with 100% accuracy and without any manual typing. If you think now then you know that this process is nothing else then scam because not one company at the world will spend US$ 7 million for a data entry process where they need to prove the data for the same amount again if they can get the work done for less than US$ 10,000, in less than a week and without any risk for getting fined!

Summary: We see in this case how campaigns are getting traded from one retailer to next one. As scammer are lazy they are even not proving if the campaign is possible in respect to the law of the outsourcing country. They only like to earn from retailing campaigns. Such people like Ambuj Sahoo together with the greediness of the center owners have destroyed the complete offshore outsourcing industry. As the customer data got traded and the problems have been coming larger the traditional outsourcing countries have adjusted their data protection law. For this the offered campaigns where customer or consumer data are involved are nothing else than SCAM.

Who is a retailer of a scammer need not wondering himself to get called to be a SCAMMER! It does not matter if someone is scamming by himself or retailing from a scammer. The result for the center and in both cases the same. The result in front of the law court is for the scammer and his retailer the same too.

Update July 17, 2015 9:40am GMT: In the Facebook Group GENUINE OUTSOURCING tries to explain me Sumanta Kumar Pradhan that I'm wrong. Sumanta Kumar Pradhan tries to do this the same way like Ambuj Sahoo only with statements without prove. Even an offer to tell me where I have made a wrong calculation remains unanswered. Observe please how Sumanta Kumar Pradhan is contradicting himself during the discussion and how he is dismanteling himself in faking proves.

Typical for a scammer is that he cannot show his face in his profile because he does not like to provide a manhunt picture by himself. So Sumanta Kumar Pradhan do it too.

Why all these campaign offers from the low wage countries are SCAM?

Scam SchoolA company, which likes to outsource a campaign, is searching for a consultancy or outsourcing agency locally. The reason for this is that they like to feel save and have the same law situation for a contract. A local company can get easily verified. The hired consultancy agency gets paid from the outsourcer directly. It is normal that this one, which hires someone, pays the bill for it. For this are all these campaign offers with upfronts, royalty or however the fee is getting called nothing else then scam, because it shows that the broker or consultant does not have any contract with the client.

If a outsourcer is searching on the Internet abroad, then this one will not search for a consultancy agency or broker. Such a company is searching directly for a center, which can do the work. The contract structure and the verification process will be much more costly in time and workforce then to hire a consultant, which is doing all the work for them.

Additional has each one to respect the law in the destination country of the call. Consumer and customer data are in the traditional outsourcing countries (Australia, Canada, Europe Union, Ireland, New Zealand, USA, etc.) protected by law and are not allowed that others get access to them. Even if customer data are getting stolen this one, which has stored them, has to pay a fine. A nice example for this is the case from AT&T where 280,000 customer records got stolen from their own call center staff. AT&T had to pay a fine of US$ 25,000,000 for this case.  Do you really think that one of such companies give you access to their customer database when they are expecting such fines?

This shows already the reason why all the offered inbound and form filling campaigns are nothing else then scam.  You need only to think about it who is calling or which kind of forms should get filled. The most calls a company receive are coming from customers of the company. What can you do with such an incoming call if you have no access to the customer database? You are only able to forward the call to somebody, which has access to it. In such a case this one can pick up the call by himself too. The company will not save anything by outsourcing such a process. So why they shall outsource this kind of process?

Think now about the form filling process. Such campaigns have been available before the digital revolution has started. I started programming computer systems around 38 years ago. Since 30 years are already personal computer available. 1986 got the SQL (Structured Query Language) the first standardization. Since around 20 years are SQL databases in common use for storing data. That means all the data, which should get filled in forms, are already since more than 20 years digital available and the programs are able to fill forms automatically. There is no need to enter some data manually – the digital Stone Age is already a long time over! Why should you pay someone for a copy and paste work if there are programs are available which are doing the work within seconds?

Do you really think that any author is writing by hand or on a type writer? The first program I remember having used for writing letters has been Wordstar. The version 1 got sold already in the year 1978. It has been running on the CP/M System from Digital Research already and got later on ported to the system of MSDOS. Since 1983 is Microsoft Word available. Why should an author use a type writer or write his books by hand in this case? It is much easier to type it on a computer and forward it by email to the publisher, the editor can make easily his changes and forward it directly to the pressroom. With the export function is it easily to bring the book without typing into the eBook format. There is no manual interaction necessary. The books are getting stored for a reissue. Even old book got already digitalized during the past 30 years. So there is no need for eBook typing. Think about it, why should you pay an upfront fee for such a work? The answer is very simple: The scammer cannot get paid from any client for the invented process and the upfront fee is his only possible income in this case!

The next big scam is the tech support where the center should buy calls and charge the caller for the provided service.  In this case the center takes the risk about the way the calls are getting generated. A legal way to generate such calls is with advertising not possible. With advertisings at the best visited sites you can get one or two calls per day, because everybody knows someone, which can help by computer problems. The most common problems are network and driver problems. With network problems you have no access to the remote computer and cannot give any help. Driver installation from remote is very difficult too because in the most times you need exactly the model of the hardware part. An end user will not be able to tell it to you. In such a case are only the calls remaining, which are generated by scareware. Such scareware is illegal and the center can up in jail for making money generated by scareware, viruses, ransomware, etc. As the center is making money with the incoming calls is it reasonable that the center is the programmer or the distributor of the criminal software. The seller of the calls will be already trackless disappeared in such a case and the center owner will be alone in front of the law court. The devil takes the hindmost.

 

Which campaigns are remaining for offshore call centers in such a case?

The situation is very simple.  Campaigns other than lead generations from already heavy used data, which are getting traded between the centers, are not really available.

All the offered products from the real campaigns are on a pay per sale base and are well known from the spam emails. To sell such products by already heavy used calling data is not really easy and profitable. It is only profitable for the outsourcer because he is even saving the cost for the staff and has no risk about his product which is unsaleable on a normal way. For the center is it like fishing in troubled waters by taking all the risk.
